If you work for a hotel, motel or resort in Pennsylvania, perhaps the most significant obstacle you face after a work injury is the "sham light duty" return to work offer.

Hotels and Hotel chains are notorious for having overly aggressive "return to work" programs.  Typically, the employer insists you see only the doctors they recommend -- even if they have not met their obligations under the Act to give them any right to do so -- and then push those doctors to release you to return to work as soon as possible, often long before you are ready.  What is worse, in the hotel industry, it is then common for hotel managers, housekeeping directors or other supervisory personel to then all but ignore any stated "light duty" restrictions.

We have had clients with very substantial restrictions -- such as limited weightbearing on an injured foot -- ordered to "just do what you can" by supervisors who then expect them to do all of their normal duties, without regard to the fact that this is prolonging or worsening the injury.  Often, the employers just don't care -- they want you back to work, period, and once you get there, your recovery and good health, or lack of it, are no longer their concern.  We frequently see workers get MUCH WORSE, rather than getting better after a work injury, because thier employer and the employer's chosen doctor pushed the injured worker back to work too soon in the expectation of saving themselves from expensive workers compensation obligations.

Sometimes the way too early "return to work" ploy is made even worse -- as when the employer then looks for any possible excuse to end the employment, often with the injured worker still struggling physically from an injury and under circumstances where the workers compensation rights are far from secure.
