Proving a work-related closed head injury, or traumatic brain injury, can be a difficult prospect.  Establishing that such an injury has caused long-term impact on your ability to work can be even more frustrating.  Insurance companies hesitate to make referrals to the proper specialists, and the typical hired-gun company doctors are quick to release workers to return to work.  In more serious cases, or those where the insurer wants extra help avoiding long-term exposure, the insurance company may use the services of a Nurse Case Manager to try to direct the content of related medical documentation or to encourage the injured worker to get back to work without regard to lingering deficits and difficulties.

Still more problems are encountered when the victim of a work-related traumatic brain injury is sent for an IME (supposedly an "independant medical examination" but more properly an "insurance medical examination").  The insurance company will typically send you to one of their tried and true IME neurologists -- rather than a more appropriate neuropsychologist.  We have seen even well-documented, objectively confirmed cases of traumatic brain injury dismissed as mere "symptom magnification" by insurer-friendly IME doctors who go through the patient's chart page by page and downplay all that they find, on the grounds that so many of the symptoms of a closed head injury are "subjective."  How can you prove, after all, that you really are having debilitating headaches, disorienting mental lapses, unusual distractability, buzzing in your ears, visual disturbances, light sensitivity, or any one of multiple potential signs of an actively symptomatic traumatic brain injury?  How can you prove how these symptoms interfere with your abilty to return to the workforce -- let alone function on a day to day basis?  Even your ability to articulate your symptoms may be twisted by the insurance company to use against your claim.
