      The common way to "settle" a Pennsylvania Workers' Compensation Claim prior to the late 1990s was by a "commutation of benefits."  Some claims settled even after that date were also resolved by commuting benefits, but in very recent years the commutation mechanism has become extremely rare.  This is due to the availability of the Compromise and Release as a means to settle all or any part of a Pennsylvania work injury claim. 

     A commutation would result in a claimant being paid future compensation benefits, up to a maximum of 500 weeks, in a single lump sum.  Medical expense benefits would generally remain the employer's obligation, at least technically.  In practice the parties would at times reach an understanding that the amount of the lump sum paid was intended to resolve the defendant's obligations for medical billing, as well as wage loss -- but such an agreement would not be properly enforceable under the Workers' Compensation Act when commutation of benefits was the sole settlement mechanism. 

      In general, if your claim was subject to a commutation rather than a compromise and release, you may still have valuable rights.  You should discuss your situation with a competent workers compensation attorney.
