      The fee we earn in workers' compensation cases is a "contingent fee."  That is, our fee is contingent on our first securing your rights.  If you don't get paid, we don't get paid.  Fees apply ONLY when when we win in court or obtain a lump sum settlement on your behalf.   The fee is equal to twenty percent (20%) of the benefits we secure for you by litigation in court or via a lump sum settlement in your favor.  This is the going rate for a Pennsylvania Workers' Compensation Attorney. 

      While it is always going to hugely help your claim to act as early as possible to get a competent, conscientious and tough attorney on your side, giving you good advice, please know that in many situations, you won't have to pay anything for that advice and guidance for many months from the time you first hire us, and then only if we first secure for you a right to continuing benefits or a lump sum settlement that meet your needs.

      Unlike many other firms, The Law Offices of Timothy Kennedy will advance all costs of litigation.  These costs typically run to several thousand dollars in a given round of litigation in the workers' compensation courts.  Costs cover such things as expert witness deposition fees, court reporter fees and records service fees.

      Most importantly, we have made our reputation by always being very careful to act strictly in the best interests of our clients.  Many clients come to us while already receiving benefits.  Even when there may be legal issues that would justify litigation, that may not be in our client's immediate best interest.  In many cases, watching, waiting and building and strengthening the client's claim is the best overall course. 

     Because our philosophy always puts the client first, we sometimes spend months or even years monitoring and strengthening an open claim, with our client's benefit checks coming uninterupted, without triggering a fee interest for our firm.  This ultimately pays, since when the time does come and the insurer attempts to stop benefits, the claim is strong enough to ensure a win for our client, or better still a lump sum settlement for the fullest possible value and on terms most favorable to the client.  This is what then triggers our fee interest, but in a case now made strong and on a timetable we have influenced to our client's advantage.

      In other cases, a new client may come to us very anxious to move his claim toward a large lump sum workers compensation settlement.  We have mechanisms to do just that.   Where it is in the client's best interest, we can and will move quickly to position the claim for maximum impact and the best possible lump sum settlement.

      Bottom line: all workers' compensation attorneys charge the same twenty percent contingent fee amount, but some have strings attached, and some cannot be fully relied upon to pursue the claim professionally and with your interests foremost in mind.  At The Law Offices of Timothy Kennedy, we talk to our clients.  We educate them about their rights and their options before we take action, and we carefully consider the timing of every move we make, working hard to ensure that we never fall out of step with the best interests of the particular client in the particular case, rather than trying to make each claim fit a pattern or formula.
